Access Tyler Court Case Records

Start at the clerk's office that holds the file. Tyler County court case records cover the docket, filed papers, orders, judgments, and certified copies for Circuit, Family, and Magistrate matters, and the right case number plus the right court gets you there fastest. Some Circuit files can be viewed online. Magistrate searches return case information and send document requests to the local clerk. Both the Tyler County Circuit Clerk and the Magistrate Court Clerk will help at the counter, by phone, by mail, or through a written request. Family, juvenile, sealed, and expunged material carries protections, so parts of those files stay out of public view.

Tyler County Court Record Requests

Tyler County court case records start with the court that holds the file. Use WVPASS for public Circuit Court civil and criminal files. It can provide public documents dating back to 1999. Use MCRSearch for Magistrate case information, then contact the Magistrate Court Clerk for the papers. Family Court orders and indices can be public, but much of the file remains confidential.

The Circuit Clerk accepts requests at the counter, by phone, mail, fax, and targeted writing. The Magistrate Clerk has the same direct fallbacks, and state materials confirm public terminals in Magistrate clerk offices. No Tyler court-record email request channel or online certified-copy checkout was located. A request should name the court, case number, caption, date range, exact paper, desired format, and copy type.

  1. Identify Circuit, Family, Magistrate, municipal, estate, federal, or transcript jurisdiction.
  2. Search the proper portal and note the case number, entry date, and document title.
  3. Ask the custodian for a specific docket sheet, pleading, order, judgment, exhibit, or payment record.
  4. Confirm the copy form, fee, payment method, delivery route, and current turnaround.
  5. Send a written request under West Virginia law when the public record is not online.

A transcript is a separate route. Ask the court reporter about production rather than assuming the clerk holds a ready transcript. Tyler sources identify reporters for the Circuit judges but do not publish a transcript price or request process.

Three Tyler Court Record Layers

A Tyler County court case record has three practical layers. The docket is the dated index of filings, settings, orders, and disposition. The filed-document layer contains the complaint, answer, motion, exhibit, order, or judgment named by an entry. The authenticated layer is a certified or exemplified copy issued by the clerk for formal use.

Docket
The chronological case history and event list.
Filed document
The actual paper behind a docket entry.
Certified copy
A reproduction authenticated by the clerk.
Exemplified copy
A copy with an added form of authentication.

A WVPASS download is not automatically certified. A MCRSearch result may list a document without showing its image. Ask the receiving body which form it needs before paying for Tyler County court records.

Kinds of Court Records

The Tyler County Circuit Clerk keeps Circuit and Family civil, criminal, divorce, custody, support, mental-hygiene, guardianship, domestic-violence, juvenile, and lower-court appeal records. The Magistrate Court Clerk keeps misdemeanor, traffic, preliminary felony, small-claim, limited civil, and protective-order matters. Access depends on the record and the governing rule.

  • Docket sheets, case histories, and setting entries.
  • Complaints, petitions, answers, motions, and service papers.
  • Orders, judgments, dismissals, sentences, and dispositions.
  • Filed exhibits and attachments when public.
  • Plain, certified, exemplified, and abstract forms supplied by the clerk.

The Tyler County Clerk at 350 Park Avenue handles wills, estates, and county records. That office is not the Circuit Clerk. Federal cases use PACER and the Northern District of West Virginia rather than WVPASS or a Tyler trial-court clerk.

Tyler Portal or Clerk Copy

WVPASS offers the fastest online route to many public Circuit documents. Public registration and search are free. Downloads cost 25 cents per page plus a card-processing fee. MCRSearch is free and needs no registration, but it offers case information and a document list rather than document images.

An online entry is a lead, not proof of each term in the file. The clerk can confirm whether a paper is public and what copy form is available. The Tyler County docket search can help find the controlling case number before a copy request.

Court Records: What They Contain

A Tyler County court case record can contain a case header, party information, the cause or charge, chronological entries, hearing settings, money entries, disposition, cross-references, and public documents. Exact fields vary by court and case. Protected addresses, account numbers, and other sensitive identifiers may be removed.

Case headerCourt, number, caption, filed date, judge, type, and status when published.
PleadingsComplaints, petitions, answers, motions, and service papers.
Orders and judgmentsSigned rulings, disposition, sentence, dismissal, or final relief.
Docket sheetDated entries for filings, hearings, orders, resets, and outcome.
ExhibitsFiled evidence or attachments when not sealed or confidential.

No official Tyler-specific Circuit case-number format or docket-code glossary was found. Enter the identifier exactly as issued. If a short label controls a deadline, hearing, or judgment, ask the clerk what it means instead of guessing.

Older Tyler Court Case Records

WVPASS coverage of public Circuit documents reaches back to 1999. A blank result for an older Tyler County court record does not show that the file never existed. Court records can remain in paper, bound docket books, microfilm, digital images, or archive storage. Ask the Circuit Clerk about the retention format and whether retrieval takes more time.

MCRSearch launched in 2024, while the Magistrate case-management system began statewide operation in 2016. Portal launch dates do not erase earlier records. For an archived matter, give the court, old case number, party names, and a narrow date range. Official Tyler sources do not publish an archive turnaround or off-site retrieval fee, so confirm both before ordering.

Copy Fees and Certification

A plain Tyler County court record is an informational copy. Certification adds the clerk’s authentication. An exemplified copy carries another form of authentication and costs $3 plus copy cost. Ask the recipient what form is required. Tyler’s page does not list a separate certification surcharge, so no amount should be assumed.

Narrow Tyler Record Requests

A narrow Tyler County record request is easier for the custodian to answer. State the case number, court, date range, and exact paper. Say whether an electronic, plain paper, certified, or exemplified form is needed. West Virginia law supports electronic copies when a public record exists electronically and that format is requested. The custodian need not create a new summary from scattered records.

The Circuit Clerk is at 230 Main Street, open weekdays from 8:00 a.m. to 4:00 p.m., with mail to P.O. Box 8, Middlebourne, WV 26149. The Magistrate Clerk is at 225 Main Street, open weekdays from 9:00 a.m. to 4:00 p.m., with mail to P.O. Box 127. Call 304-758-4811 for Circuit records or 304-758-2136 for Magistrate records. The county’s general contact form is not a court-record request form.

Note: Confirm the fee, copy form, payment method, and pickup or mailing plan before sending a Tyler County records request.

Tyler Family Record Boundary

Family Court records do not follow the same public rule as an ordinary Tyler County civil file. Family Court Rule 6 keeps orders and indices public but generally makes pleadings, recordings, exhibits, transcripts, and other file documents confidential. Parties and other authorized people may have access that the general public does not.

A public index can confirm that a matter reached court without opening the papers behind it. Ask the Circuit Clerk which material is public and what proof of authorization is needed. Adoption, juvenile, mental-health, abuse-and-neglect, guardianship, and protected domestic-violence materials can have their own limits. Do not place private data in a general web form while asking about access.

Access Rules for Court Records

Tyler County court case records are open unless a statute, rule, or order restricts them. Juvenile records are nonpublic. Sealed and expunged matters may be absent from a search. Personal identifiers can be redacted even in an otherwise open court file.

Key rules:

WV Code §51-4-2 opens court papers to inspection and copies unless another law restricts access.

WV Code §29B-1-3 sends a public-record request to the custodian and supports electronic format.

Trial Court Rule 15A.26 covers public access to the electronic Circuit docket and nonconfidential E-File documents.

If access is denied or limited, ask which rule or order controls and whether a motion or court authorization is required. The clerk can explain procedure and supply public copies but cannot give legal advice.
